Ideally, parties to a dispute should amicably approach an independent Rov or Beis Din to inquire who is right or to help them reach a Pshoro (see Sema 79:31). For various reasons however (usually because the disputants have left the matter unresolved for far too long and they no longer see eye to eye), this isn't always an option and a formal hazmono (invitation to attend Beis Din) is the only way forward.
A disputant can initiate a Din Torah by being Mazmin (i.e., by formally inviting) his opponent to a Din Torah or, alternatively, by having a Rov or Beis Din send a hazmono on his behalf.Â
